Managed Hosting Terms of Service**


1. Overview

DynamoCX provides managed WordPress hosting and infrastructure services (“Hosting Services”) designed to ensure website performance, security, and uptime.

Hosting Services include infrastructure management, monitoring, and maintenance of the website environment. These services do not include website content updates, design, or development work unless otherwise agreed in writing.


2. Hosting Environment

All websites hosted under DynamoCX Elite Platform™ are deployed within a managed cloud hosting environment powered by third-party infrastructure providers (including but not limited to WP Engine and Cloudflare).

By subscribing to Hosting Services, Client agrees to comply with all applicable third-party infrastructure policies and acceptable use standards.


3. Included Services

Hosting Services include:

  • Managed WordPress hosting environment
  • Global Edge Security (CDN, WAF, DDoS protection)
  • WordPress core, plugin, and PHP updates
  • Ongoing performance and uptime monitoring
  • Daily backups and rollback capability
  • Technical support for infrastructure-related issues

4. Service Scope Limitations

The following services are not included in Hosting Services:

  • Website content updates or edits
  • Page creation, design, or layout changes
  • Feature enhancements or functionality changes
  • Plugin configuration beyond standard maintenance
  • SEO, marketing, or analytics services

These services may be provided separately under a different agreement or on a time-and-materials basis. Requests falling outside of Hosting Services may be quoted separately or require transition to a higher-tier service plan.


5. Usage Limits & Capacity

Baseline Capacity & Plan Limits

Each hosting plan includes defined baseline capacity for traffic, bandwidth, and storage, based on the selected service tier.

Entry-level plans are typically provisioned with starting benchmarks (e.g., monthly visits, bandwidth, and storage) appropriate for standard small business websites.

Specific thresholds for each Client are determined by their selected plan and may be outlined in the service agreement, invoice, or plan documentation.

These limits are designed to maintain optimal performance and system stability.

Fair Use

Hosting Services are intended for standard business website usage.

Excessive, abnormal, or resource-intensive usage—including but not limited to traffic spikes from bots, misconfigured plugins, or atypical application behavior—may require remediation, temporary restrictions, or plan adjustments.

DynamoCX reserves the right to take necessary action to maintain platform stability and performance across all hosted environments.


6. Overage & Upgrade Policy

DynamoCX will monitor usage and notify Client when thresholds are approaching or have been exceeded.

If usage exceeds the limits of the current hosting plan, DynamoCX reserves the right to require an upgrade to a higher-tier plan to maintain performance, stability, and service quality.


7. Scalability

Hosting Services are designed to scale with Client needs.

Upgrade paths may include:

  • Increased storage capacity
  • Higher traffic thresholds
  • Enhanced infrastructure environments

All upgrades will be discussed and approved prior to implementation.


8. Support Model

DynamoCX provides:

  • Proactive monitoring and issue detection
  • Reactive support for hosting-related issues
  • Email/ticket-based support as primary channel
  • Escalation support via phone/text when necessary

Support is limited to infrastructure and hosting-related concerns.


9. Third-Party Dependencies

Hosting Services rely on third-party providers (e.g., WP Engine, Cloudflare).

DynamoCX is not liable for:

  • Outages originating from third-party providers
  • Service disruptions beyond reasonable control

However, DynamoCX will act as the primary point of contact and will coordinate resolution on Client’s behalf.

Third-Party Infrastructure Costs

In the event that Client usage, traffic patterns, or third-party service requirements result in additional infrastructure or licensing costs beyond standard hosting provisions, DynamoCX reserves the right to pass through such costs or require a plan adjustment.


10. Backups & Data Responsibility

DynamoCX performs regular backups of hosted environments.

However, Client is ultimately responsible for:

  • Maintaining copies of critical data
  • Verifying data integrity where required

11. Payment & Termination

  • Hosting Services are billed monthly unless otherwise agreed
  • 20-day written notice required for cancellation
  • Failure to remit payment may result in service suspension

12. Acceptable Use

Client agrees not to use Hosting Services for:

  • Malicious or illegal activities
  • Hosting harmful, abusive, or prohibited content
  • Excessive resource consumption beyond agreed limits

DynamoCX reserves the right to suspend services in violation of acceptable use policies.


13. Limitation of Liability

DynamoCX shall not be liable for:

  • Loss of revenue, data, or business interruption
  • Indirect or consequential damages
  • Issues arising from third-party services

Total liability shall not exceed the amount paid for Hosting Services in the preceding billing period.


14. Modifications

DynamoCX reserves the right to update these Terms of Service with reasonable notice.
